Terms & Conditions

Access to this Internet site ('the Website') is provided subject to these Terms & Conditions and any amendments that may be made thereto by Webfire Media Ltd (the ‘Publisher’) from time to time. You ('the User') shall be deemed to have accepted these Terms & Conditions by virtue of you continuing to use the Website. If you do not wish to accept these Terms & Conditions, you should stop using the Website, altogether.

The Service
The Publisher provides a service ('the Service') wherein Users are granted access to streaming media and written content ('the Content') and retail services on the Website.

The Content
The Content includes a number of short video stories. A list of all the current video stories and a brief written description of each is freely available on the Website. The Content is not intended to be a definitive exposition of the subject in each video title. Each video story is relatively concise and should be considered a brief introduction to the issues cited. The number of video stories and the style in which they are presented may change from time to time in the sole discretion of the Publisher.

Liability
Any medical and other advice and opinions expressed in the Content are the advice and opinions of the persons featured and/or the bodies cited, and not those of the Publisher itself. The Publisher is an impartial journalistic body, which does not hold, offer or endorse any opinions. You understand you should view the Content as entertainment and general background information and should consult your own doctors and appropriate experts before taking any action or relying on the Content in any way. The Publisher does not accept liability for any action you may take pursuant to viewing the Content. The Publisher will compensate you for any reasonable loss or damage you may suffer if we fail to carry out our obligations to a reasonable standard or breach any duties imposed on us by law (including if we cause death or personal injury by our negligence) unless that failure is attributed to: (a) your own fault; (b) a third party unconnected with our provision of the Services under this agreement; or (c) events which neither we nor our suppliers could have foreseen or forestalled even if we have taken reasonable care.

Accordingly we shall not be responsible for loss of or damage to your computer hardware or software or other personal property or any other losses, which you suffer as a result of the content of the Service unless this is due to our neglect or failure to take reasonable precautions and such losses are reasonably foreseeable. We strongly recommend that you (a) take care to verify the suitability and compatibility of the Service with your computer system prior to use; and (b) take reasonable precautions to protect yourself against harmful programs or devices including through installation of anti-virus software.

Downloading and Streaming

The video stories are made available to you by streaming on demand over the Internet. The Service does not permit you to download our video stories, where you retain a permanent copy on your computer. This means you never have a permanent copy of any of our content on your computer.

Viruses, sabotage and computer malfunctions
You shall be responsible for the installation of the appropriate media playing software on your computer that will enable you to view our video content. We recommend you install the latest Flash Media Player. However, we do not accept liability for your use of third party software or hardware, even where access to that software or hardware is available via the Website. Also, we do not accept liability for third party actions, such as, but not limited to the actions of computer hackers, who may sabotage the Website.

Membership
The Publisher may set up a registration and membership scheme for the Website, at which time the terms of the membership will be displayed on the Website.

Premium Pay-Per-View Content
From time to time, the Publisher may add premium pay-per-view content to the Website that is not accessible to members or Users. All users shall be required to pay such a fee as may be determined by the Publisher and advertised on the Website in order to view premium content.

The Way the Publisher Uses Information
If you submit personally identifiable information to us through the Website, then we may use your personal information to operate, maintain, and provide to you the features and functionality of the Website.

Personal information or video content that you voluntarily disclose online may become publicly available and can be collected and used by others. Any account name you might set up (but not your email address) may be displayed to other Users when you upload videos or send messages through the Website and other Users can contact you through messages and comments. Any videos that you submit to the Website may be redistributed through the internet and other media channels, and may be viewed by the general public.

We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of Website changes or for customer service purposes).

We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Website and to create new features, promotions, functionality, and services by storing, tracking, and analyzing User preferences and trends.

We use cookies, clear gifs, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Website; (b) provide custom, personalised content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.
When the Publisher Discloses Information
We provide personally identifiable information and non-personally-identifiable information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. We require that these parties agree to process such information in compliance with our privacy policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.

We do not share your personally identifiable information (such as name or email address) with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.
We do share non-personally-identifiable information (such as anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Website.

We may release personally identifiable information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with UK and EU law or respond to a court order, subpoena, or search warrant.
The Publisher also reserves the right to disclose personally identifiable information and/or non-personally-identifiable information that we believe, in good faith, is appropriate or necessary to enforce our Terms of Use, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our web site, and to protect the rights, property, or personal safety of the Publisher, our Users or others.

The advertiser may also use information regarding your use of the Website, such as the number of times you viewed an ad (but not any personally identifiable information), to determine which ads to deliver to you.
You should consult the respective privacy policies of these third-party ad servers or ad networks (see links below) for more information on their practices and for instructions on how to opt-out of certain practices. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
If the :Publisher learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps.
